A tattoo disclaimer form is imperative for anyone in the business of body art. Most people don’t give tattoos a second thought but the fact is, there is a lot that can go wrong.
Getting a tattoo is generally safe but occasionally people can have serious health problems if they don’t care for their new tattoo properly.
Having clients sign a disclaimer before any work is done has saved quite a few tattoo studios from ruin.
The purpose of a tattoo disclaimer form is to protect the artist, his or her studio and any employees from legal action brought by a client who pays for their services. It necessarily has to cover every contingency that might arise during or after the application of the artwork. Because it involves piercing the skin and applying dye, there are medical conditions that might arise in the studio or after the client leaves the premises.
Because the client is responsible for taking care of his or her tattoo after they leave the studio, there are all sorts of complication that might arise. If they don’t keep the area clean or get an infection, the artist can find himself the defendant in a personal injury lawsuit. In cases like this, a tattoo disclaimer will protect the artist as well as the business and other employees.
A standard tattoo disclaimer protects the artist and all employees from retribution arising from injury, now or in the future. It also exempts them from legal action by the subject’s heirs and estate. A carefully worded disclaimer states the client is not under the influence of drugs or alcohol and understands the implications of getting permanent artwork applied to their body.
Once the client signs the disclaimer the artist is protected even if they are negligent—this includes using dirty equipment or mistakes in the design. By signing the disclaimer the client also asserts they understand how to care for their tattoo while the skin heals and that are solely responsible for any infections or other harmful conditions that might arise from the application of a tattoo. By signing the disclaimer or waiver form, the client affirms that they have no communicable blood borne diseases or viruses nor are suffering from heart disease, fainting, epilepsy and a host of other medical conditions.
A basic tattoo disclaimer form should also state that the client agrees to absorb any costs of legal action that they bring against the artist, tattoo studio or other employees if the artist wins the suit. In fact, the chances of legal action are reduced significantly once the client signs a disclaimer that is properly worded.
No tattoo artist should do any work without first having the client sign a comprehensive tattoo disclaimer and waiver form. It may be a bit troublesome, but a good disclaimer will help reduce the chances of the artist having legal problems.
